The executive team at 4play2nite takes your privacy very serious. This is why we have developed the following policy to insure your privacy.
1. Special Note about Children and Minors:
Children under eighteen (18) years of age are not allowed to utilize our services. Only people, over the age of eighteen (18) years of age may join our community. We ask that children and minors under the age of eighteen (18) years not attempt to access our site and/or create an account. If you are under eighteen (18) years of age, please do not attempt to register for 4play2nite or send any information about yourself to us, including your name, address, telephone number, or email address. No one under the age of eighteen (18) years may provide any personal information to or on 4play2nite. In the event that we learn that we have collected personal information from a child and/or minor under the age of eighteen (18) years, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child and/or minor under the age of eighteen (18) years, please contact us. 2. About 4play2nite and Information We Collect:
4play2nite is an online social networking group designed to provide useful social tools that allow online communities to explore, share, build relationships in an online environment, and improve couples sex life. 4play2nite's Privacy Policy is designed to help you understand how we collect and use the personal information you decide to share, and help you make informed decisions when using 4play2nite, located at www.4play2nite.com and its directly associated domains (collectively, "4play2nite" or "Website"). By using or accessing 4play2nite, you are accepting the practices described in this Privacy Policy.
a. This Privacy Policy applies to the services offered by 4play2nite, including any 4play2nite Website, the 4play2nite instant messaging service, and other features (for example, photo and video embedded players), 4play2nite mobile services, and any other features, content, or applications offered from time to time by 4play2nite in connection with the 4play2nite Website. In addition, we collect address, credit card, and bank information. However, none of the personally identifiable information associated with your credit card can be accessed or used by the public. This information is only used for age verification, credit card fraud protection, and billing purposes. Again, in taking your privacy serious, your credit card statement will indicate our corporate name SJM Holdings. By using 4play2nite, you are consenting to have your personal data transferred to and processed in the United States.
b. In the course of using our site, we automatically track certain information such as your IP address, aggregate user data, and browser type. This data is used to manage and improve the 4play2nite services, track usage, and for security purposes. In addition, we store certain information from your browser using cookies. We use session ID cookies to confirm that users are logged in. These cookies terminate once the user closes the browser. By default, we use a persistent cookie that stores your login ID (but not your password) to make it easier for you to login when you come back to 4play2nite. You can remove or block this cookie using the settings in your browser if you want to disable this convenience feature. If you choose to post messages, comments, blogs, photos, pictures, use chat rooms, or other message areas, we will only display such information about you as you choose to reveal. This information is typically just your alter ego (user name).
c. If you send us personal correspondence, or if other users or third parties send us correspondence (emails or letters) about your activities or postings on the site, we may collect such information into a file. This file is only accessed by authorized personnel for purposes of maintaining site harmony and ongoing continuous improvement purposes.
d. If you choose to use our referral service to tell a friend about our site, we will ask you for your friend’s name and email address. We will automatically send your friend an email and up to 2 follow-up reminders, inviting him or her to visit the site. 4play2nite stores this information for the sole purpose of sending this email and tracking the success of our referral program. Your friend may contact us at Customer Service to request that we remove this information from our database.
3. Our Use of Your Information:
When you register with 4play2nite, you create your own profile and privacy settings. Your basic profile information (profile picture, alter ego or user name, country, and potentially other basic information) is viewable by all members. Your complete profile information, as well as your name, email and photo, are displayed to people in the groups specified in your privacy settings to enable you to connect with people on 4play2nite. You control how much or how little your group friends can see. We may occasionally use your name and email address to send you notifications regarding new services offered by 4play2nite that we think you may find valuable.
a. Profile information is used by 4play2nite primarily to be presented back to and edited by you when you access the service and to be presented to others permitted to view that information by your privacy settings. In some cases where your privacy settings permit it (e.g., posting on your recent activity), other 4play2nite users may be able to supplement your profile.
b. We internally use personally identifiable information of our users to improve our marketing efforts, to statistically analyze site usage, to improve our content and product offerings as well as to customize our site's content and layout. These uses allow us to improve our site and better tailor your online experience to meet your needs.
c. We may also use personally identifiable information about you to deliver information to you that, in some cases may be targeted to your interests, such as banners and promotions.
d. We also send periodic informational updates to our members via email. Generally, you may opt out of such emails, though 4play2nite reserves the right to send you notice about your account even if you opt out of all voluntary email notifications. Further, we use personally identifiable information to resolve disputes, troubleshoot problems and enforce our Terms Of Use Agreement.
4. Our Disclosure of Your Information:
4play2nite is about sharing information with other community members, friends and people in your groups, while providing you with customizable privacy settings. We allow you to choose the information you provide to the general community members, friends and groups through 4play2nite. Your privacy settings allow you to make informed choices about who has access to your information.
a. We DO NOT sell, rent, or distribute any personally identifiable information about you to any third party without your permission. We do disclose information in aggregate to advertisers and for other marketing and promotional purposes. However, in these situations, we DO NOT disclose to these entities any information that could be used to personally identify you. Certain information, such as your password, credit card number, and bank account number, are not disclosed at all.
b. 4play2nite may contain links to other websites. We of course are not responsible for the privacy practices of other web sites. We encourage our members to be aware when they leave our site to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by 4play2nite.
c. Advertisements that appear on 4play2nite are sometimes delivered directly to users by third party advertisers. These third party advertisers may also download cookies to your computer, or use other technologies to measure the effectiveness of their ads and to personalize advertising content. In this way, they may compile information about where individuals using your computer or browser saw their advertisements and determine which advertisements are clicked. 4play2nite does not have access to or control the cookies that may be placed by the third party advertisers. Third party advertisers have no access to your contact information stored on 4play2nite unless you choose to share it with them.
d. Unlike most sites on the Web, 4play2nite blocks access to site information by third party search engine "crawlers" (e.g. Google, Yahoo). 4play2nite takes action to block access by these engines to personal information and profile settings. This information is limited to members only per your personal privacy settings. Limited information is allowed, but only with member consent.
e. In order to maintain a healthy community, 4play2nite cooperates with all law enforcement inquiries and with all third parties to enforce their intellectual property or other rights. We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to comply with a judicial proceeding, court order, or legal process, protect our rights, interests or property and prevent fraud or to prevent imminent bodily harm.
f. When you use 4play2nite, certain information you post or share with third parties (e.g., a friend or someone in your group), such as personal information, comments, messages, photos, videos, or other information, may be shared with other users in accordance with the privacy settings you select. All such sharing of information is done at your own risk. Please keep in mind that if you disclose personal information in your profile or when posting comments, messages, photos, videos, or other items, this information may become publicly available.
g. If the ownership of all or substantially all of the 4play2nite business, parent company and/or subsidiaries were to change, your user information may be transferred to the new owner so the site operations are not interrupted. In any such transfer of information, your user information would remain subject to the pre-existing Privacy Policy.
5. Your use of Other User’s Information:
You may not use other user’s information for commercial purposes, to spam, to harass, or to make unlawful threats. 4play2nite reserves the right to terminate those who misuse other user’s information or who otherwise violate the 4play2nite Terms of Use Agreement, without refund.
6. Reviewing and Changing Your Personal Information and Password:
You may not disclose your password to any third parties or share it with any third parties. If, despite the foregoing, you lose control of your password, you may lose substantial control over your personally identifiable information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately change your password. We strongly urge you to periodically change your password to help reduce the risk of unauthorized access to your account information.
a. Once you register, access and control over most personal information on 4play2nite is readily available. You will be able to review and change much of your personally identifiable information at 4play2nite. Including your email address, city, state, zip code, country, your profile, and password.
b. You may terminate your Membership at any time, for any reason, by following the instructions on the Member's Account Settings page. Removed information may exist in backup copies for a reasonable period of time, but will not be generally available to members of 4play2nite.
c. Upon your request, we will remove your credit card number and credit card expiration date from our main databases. To make this request, contact us at inquiry@4play2nite.com, subject line must be titled "Attn: Information". We will retain in our files information, including credit card information, you have requested to remove in some circumstances, such as to resolve disputes, troubleshoot problems, comply with Credit Card Merchant Banking and Association Agreements, enhance security, reduce fraud, comply with Federal and State Law, and to enforce our Terms of Use Agreement.
7. Security:
4play2nite takes appropriate precautions to protect our user’s information. Your account information is located on a secured server behind a firewall. When you enter sensitive information (such as credit card number or your password), we encrypt that information using secure socket layer technology. Furthermore, 4play2nite does not store your credit card number via hard copy or electronically, locally or on our servers; this data is only used by our merchant and is not accessible by 4play2nite staff. Third party service providers (merchant) are contractually required to be PCI DSS compliant and to acknowledge responsibility for credit card information security. 8. Terms of Use Agreement, Notices and Revisions:
Your use of 4play2nite, and any disputes arising from it, is subject to this Privacy Policy as well as our Terms of Use Agreement. We reserve the right to change our Privacy Policy and our Terms of Use Agreement at any time. If we make changes, we will post them and will indicate at the top of this page the policy's new effective date. We encourage you to refer to this policy on an ongoing basis so that you understand our current privacy policy. Unless stated otherwise, our current privacy policy applies to all information that we have about you and your account.
